Since the widespread adoption of laparoscopic cholecystectomy by surgeons in 1990, litigation surrounding bile duct injury alone has surpassed similar litigation for open cholecystectomy by more than 20-fold. Information from medical litigation serves as an important educational tool for surgeons. Clinicians should be actively involved in a medicolegal analysis of bile duct injuries because it is the clinical expert witness who must educate the lay jury regarding the standards of care in laparoscopic surgery.
