In a recent decision, the Federal Circuit continues to expand the definitio of a printed publication with regard to patentable matter. Fundamental to the rights granted by a patent is the fact that the subject matter being patented is in fact novel. Since the advent of the US Patent Act of 1790, novelty was accepted as precondition for patentability, though the clarification of how to establish compliance, and what guidelines were necessary for a determination of novelty continually evolve....
