Basically the law regulating intellectual property rights (IPR) gives monopolized rights to the inventor exerting technology as a result of his invention, and reserving the right to prevent anyone to use or access such technology without his express consent. Meanwhile, the antimonopoly law creates rules of the game for business people to run their business in a fair and honest manner. One of the questions drawing the attention of competition law is the extent of the influence of intellectual property rights. The fact that no complete rules on these issues are available opens the possibility for business persons using IPR to take monopolistic or anti competition measures. If one keeps in mind the highly complex issue of an agreement for an IPR license, then the effort perfecting regulations on anti - monopoly and unhealthy business competition should consider an alteration of article 50 of law number 5 year 1999 on the prohibition of practices of monopoly and unhealthy business competition, particularly regulating exceptions of the IPR agreement. I the event, such change would occur, then automatically each IPR agreement, particularly the agreement on patent licenses, may not consist of elements contradictory to the principle on the prohibition of monopoli practice and unhealthy business competition. Consequently, the authority competetent in drafting guidelines for and implementing an analysis of a license agreement is the supervisory commission on business competition (komisi pengawas persaingan usaha = KPPU) taking into account that this commisssion also functions quasi legislative and quasi judicial.
