Land as capital asset, is a factor of capital in the economic development. The arrangement og land as guarantee is included in the authority of the state to determine and to regulate legal relations between men and conducting laws on land, water and space. In the agrarian law (UUPA) not everyone is entitled to (become subject of) a certain right on land, because said subject title is restricted to the nationality of this person, because of which not everyone living in indonesia is entitled to certain rights. However with government decree number 40 year 1996, which expands the legal subject right to use, foreign residents in indonesia are allowed the right to use state land, as a person (subject) with the right to use. Herewith these foreign residents can use the rights they own as security rights object. In case there upon foreign residents, as subject with the right to use state land, are given the opportunity to obtain credit facilities with security rights on the right to use state land, the credit facility, meant for indonesian citizens in need of fluent capital for the economic development, will be used by the subject of legal guarantee based on the right to use said state land. Meanwhile, if the debtor, guaranteeing land with the right to use state land, is declared bankrupt, automatically the land becomes the object of confiscation, whereas the land itself is not under the personal authority of owner of the right to use.
