Business face a lot of barriers in entering a market in a country such as indonesia. They may be natural barriers or policy generated barrier. During new order era, several government regulations such as control over marketing of several primary commodities, price control, complicated licencing. State company's domination ad hoc government intervention, preferential treatment to particular industries or companies constitutes the source of artificial barriers to domostic competition. Letter of intent executad by the government of the republic of indonesia and international monetary fund (IMF) in the framework of structural reforms has eliminated the barriers. However, law enhancing the realization of fair domestic compotition and not giving opportunity to the existences of artificial barriers in the future is indeed required. Currently there are actually several providions on domestic competition such as law on principles of industry law principles of small business, criminal law of procedure, civil law of procedure or law on limited liability company. However, they can not yet completely overcome issues on monopoly and artificial barriers hampering fair competition. Actually, exonomic policy environment constitutes an effective instrument to create efficient and highly competitiy companies or industries. To this end law number 5 of 1999 regarding anti monopoly and unfair business competition practice is established. This article puts emphasis on the necessity to pay attention to economic aspects in implementing law number 5 of 1999 which topics on categorization of monopoly, unfair competiiton,c artel, price fixing, market dividion, merger cross - share holding and so on.
