Isi artikelDumping is the practice of selling goods in one market at a price below that charged in another market. The notion of a ‘fair value” is usually associated with the higher price by industries competing against the lower price, and the antidumping laws are used to impose a tariff on the “unfair value” of the lower-priced goods. Relating to the implementation of the new General Agreement on Tariff and Trade (GATT) Antidumping Agreement, which was drafted in the spirit of fair and open trade, Indonesian governments was required to follow certain rules in determining when dumping cases may legimately be filed by domestic producers, and specifies some procedures that must be followed in calculating whether goods are being sold “at less then fair value”. Beside, domesticindustnal communities was demanded to know and master antidumping laws, not only their antidumping laws but also GATT Antidumping Agreement and foreign countries antidumping laws. Concerning with that issue, this article want to explain the aspects of antidumping laws and analyze how far Indonesian government and its domestic producers have been ready to face the dumping’s plaintiff and to accuse foreign producers that was alleged doing dumping.
