Land procurement for public facilities can be achieved by government by the changing ownership through transaction between government and the landlord. This transaction procedure may not leave unnecessary problem, if both parties agree in doing so. However the problem may emerge if land - owners have discrepancy in land - pricing with the government who eager to acquire the land with his - own pricing policy. Conflict may become bitter if there is involvement of scalper. Since 1961, the land procurement for public facilities has been regulated by Law No. 20 of year 1961, then government regulation No. 15 / 1975 about domestic investment which is then replaced by Presidential Decree No. 55/1993. Neverthless, the implementation of these regulation still ahs some residual problems such as conflict of interest within community. Therefore the existence of Precidential Decree No. 55 / 1993 may need to be revised in accordance with Law No. 22 / 1999 about Local Autonomy and Law No. 25 / 1999 about financial balancing between central and local government.
