Paying with privacy when the price is zero? A tale of the forgotten fundamental right in social networking sites (SNS)

Social Networking Sites (SNS) have been enjoying a profound growth in Indonesia and elsewhere around the world posing conventional human interaction to new challenges. The use of Facebook, Twitter, Google+, and the likes has been seen as a new way to interact more easily with others and the services for zero prices has become a major attraction for many users. Along with this development, the collection, processing, and use of user personal data by SNS have raised concerns on privacy, although it might seem less in Indonesia. The paper focuses on two issues. First, it discusses the role of user data in SNS industry characterized by the work of network effects. Second, it deals with the question whether Indonesian laws have taken into account of the interest of privacy protection when dealing with SNS that offer their services for zero prices. The purpose of this paper is to set a wake-up call to promote the awareness of user right to privacy as part of their fundamental rights.The study is based on normative legal study. Personal data is a powerful tool for SNS as data controllers to establish a strong foothold in the market; thus, a vital input to induce competition. With the work of network effects, personal data becomes essential for online services like SNS operating as multi-sided platform (MSP). While privacy has been acknowledged in Indonesian Constitution of 1945 as part of the fundamental rights and the protection is further implemented under Law No. 11 of 2008 on Electronic Information and Technology, the necessity of a more comprehensive protection calls upon the enactment of the Law on Personal Data Protection. However, policing privacy protection might encounter problems, among others because users in Indonesia are very price-sensitive and care less about their privacy.
