Constatation of torture on child as a crime in the legislation, either in gen eral or specific legislation, basically have been sufficient. The constatation in fact are functional as an indirect protection upon child as victim of torture. The protection on child somehow still need other kind of instruments which may be satisfactory for those victim of torture. Beside, the constatation of torture as a crime contains the intens to prevent crime through the using criminal law. The prevention of torture through non-penal policy seems had been constated by legislative, eventough unexplicitely stated as comprehensive criminal prevention.
