Existence and reformative function of the Constitution Council in concep tual frame of constitutional state, seem that it is still half-hearted in reality. The consequences seem paradox to the goal of its formerly founded. Due to this condition, existence of all new political institutions inclusively the Constitution Council in turn must be reexamined whether the existence of those new political institution effective provide precise solution or even rise new problem which may be more crucial for the continuity of law reformation. The wish to found a new institution in line with the advancements in developed countries must be based on capability of the nation. Only if the nation really need the presence of an institution or commission or any other name of political institution, the needed institution must be founded on the base of real necessity.
