Indonesia has ratified two human rights conventions that prohibit torture, cruel, inhuman, and degrading treatment and punishment. One of Indonesian provinces, Nanggroe Aceh Darussalam (Aceh), which is one of regions that have special autonomy status, enacts a provincial bylaw (Qanun Jinayah) that allows flogging and stoning to death as punishments. Based on international human rights law, prohibition of torture cannot be derogated in all circumstances. Furthermore, according to the jurisprudences of the UN Human Rights Committee, international tribunal/courts’ judgments, and opinion of prominent human rights scholars, it is stated that stoning to death and/or flogging or whipping breach international human rights law such as Convention against Torture and International Covenant on Civil and Political Rights. By applying Qanun Jinayah, there is indeed a possibility for Indonesia to violate international human rights laws as well as customary international law related with cruel and inhuman punishment.
