The human right to health is an obligation under international law and Indonesian Constitution that should be taken into account within the Indonesia's policy and regulation. Addition to that, Indonesia has ratified the International Covenant on Economic, Social and Cultural Rights in 2005. Regarding the notion that human health is human rights, it is important to analyze whether is there any improvement on the health rights when the role of local government has been more widespread and impact huge role within the policy framework that can be reach the people that need a health care. However, this right is one of the rights that most of the time seems to be forgotten. In the era of decentralization, the local government is still lacking of the concept of the enjoyment of the human rights to health is a vital to all aspect of a person's life and well being regardless their social level, religions, gender, race and ethnicity. In most cases, the government reacts to the need of health care but lack of the protection of health rights that beyond the service per se. The government also fails to link the health right with the environment protection. In most of the cases, the local government exploits the environment to gain benefit financially to support their power but fail to protect the environment to support the health rights. |
