Abstract
The fast growth of the retail industry in Indonesia is marked particularly by its opening up to foreign investment in 1998, in the same year as Rupiah, the Indonesian currency, suffered a severe depreciation The remarkable development of the industry draws attention on its complexity with regard to the business characteristics and the relation between retailers and retailers-suppliers. This brings competition law into relevance. The study focuses on both the development and categories of the Indonesian retail industry and on how it is regulated within the framework of Indonesian competition law, Law No. 5/1999. The first subject aims at understanding the Indonesian retail industry to enable the identification of the legal problems in the perspective of competition law. The study is restricted to food retailing. The second part emphasizes on the unilateral restraints that takes form of abusive conducts by powerful retailers. This paper constitutes a recommendation to take the particular natures of food retailing into consideration for the assessment of the market definition and the analysis of unilateral restraints within the competition law framework.
