Isi artikelIn Indonesia customary land law has applied as agrarian Law, so long as it does not conflict with national or state interests. In the case of Batak-Toba customary law, an analysis of land political economics according to customary land law shows that customary land law has been able to guarantee the interests of each group in the society, by first, guaranteeing the socio-economic welfare of all social groups through regulations for allocating the right of control over reserved communal land, and second, guaranteeing land-based power for the traditional ruling elite. Guarantees such as these are basic reason for the Batak-Toba community to hold fast to customary land law, so that conflicts of interest with the government can occur whenever the latter applies national or state interests to reserved communal land.
