Bureaucracy can be percieved as personification of government because who undertakes the daylly tasks of government in order to realize national objectives is bureaucracy. So bureaucracy plays the key role to bring into reality the concept of good governance in the implementation of government tasks. Good government is a government who delivers services professionally to the society, so the necessity of society both phisically and non-phisically can be fulfilled correctly. In order to reach those objectives, bureaucracy has to work professionally based on autonomous and neutral, because he works based on expertise and not based on certain interest. The problem should be arisen when regional leaders (as governors, regents and chiefs of municipality) who are the political officials dragged bureaucracy to play in political affairs, or they are intervened for political interests. But actually that case is that the law on civil servant asserts that bureaucracy must be neutral. They must be neutral in the relation to political parties and neutral in delivery public services. This writing is to discuss the problem of neutrality of bureaucracy by yuridical approach. However, if political intervention already worked everywhere, can the principles of legality and neutrality be held up? Those problems will be discussed in this paper.
