A Violation in a house could happen to anyone; father, mother, husband, wife, children as well as house maid. The violation in a house in Indonesian's law covered by constitution number 23/2004. The aim of this research is to know the background of issued of the constitution number 23/2004, and its implications. The method used is normative law research. The result show that a violation in house-keeping done by wife against husband or husband against wife or anybody in the house is considered as a criminal act collation, according to constitution number 23/2004, as seen at article 5 a and d of the constitution number 23/2004.
