The existence of this Regulation is gladly accepted in the context of giving a clear guidance related to merger process. The questions emerged in this paper are, first, how to optimize this pre-notification Regulation in assuring legal certainty to the business actors who will conduct merger, consolidation, and/or acquisition, and second, how is the prospect of merger control in Indonesia using this pre-notification Regulation? Optimalization of this Merger, Consolidation, and Acquisition Pre-Notification in assuring legal certainty for the business actor who will conduct Merger, Consolidation, and Acquisition can be conducted by giving commitment to the business actor that Commission will not change its assessment on post-notificaton if the business actors have voluntarily submitted pre-notification. The prospect of merger control by this pre-notification very reliable because by using this pre-notification Regulation, every proposed merger complies with the spirit of fair competition. Hopefully, the implementation of this Regulation will create a new atmosphere where every merger in Indonesia will not decrease competition in the relevant market and will not harm the community.
