The United Nations (UN) has prime responsibility to maintain international peace and security, therefore since 1948 it has been establishing UN Peacekeeping Missions, which mandated to prevent conflict and maintain international peace and security. Despite their prime mandate to maintain international peace and security, including prevent human rights violations, some peacekeepers have violated their mandate by conducting sexual exploitations and abuses against children and women. One of important cases was located at Haiti, where the UN deployed MINUSTAH since 1993 to prevent widespread conflict and maintain international peace and security as well as to prevent human rights violation and improve human rights condition in Haiti. Subsequently, notwithstanding with their mandates, MINUSTAH forces has intentionally exploited and abused women and children for sexual purposes. UN, as an international organization and as a subject of international law has legal personality, and consequently it confer international responsibility under international law. Accordingly, based on international law governing responsibility of international organization, the UN as party that authorized MINUSTAH presence in Haiti must bear responsibility and provide adequate remedies, in form of compensation and satisfaction, to the victims. |
