The constitution of 1945 grants regional governments the broadest autonomy, then the regional autonomy law no. 22 / 1999 was born to giving powers to the regional authorities such as provinces, regencies and cities, unless a statute states a power to the central government. However the crucial problem of decentralisation in indonesia is how to make clear the legal frammework of decentralisation because of so many issues on the implementation of it, namely on separation threats, on foreign investment and business climate, on legal uncertainty, on good governance and democracy, etc. Theoretically decentralisation of power by itself does not lead to have negative impact on national unity, on foreign investment, etc. The problem lies on whether the legal framework for decentralisation is clear and easily enforceable or not. If the legal framework for decentralisation such as the divisions of powers, the hierarchy of laws and regulations, the status of regional regulations and the modes of conflict resolutions are not entirely clear, it will cause many problems in the implementation of regional autonomy in indonesia. However, legal uncertainty and lack of legal clarity are not merely the source of the problems encountered.
