The institutional conflict between the police and the district attorney has been accured along with the development of Indonesian justice system. The overlaping of their functions and roles initiated by enacting the HIR (Herziene Inlands Reglement) constituted the uncertainty in the judicial process. These problems were overcomed by regulating the new criminal procedural law No. 8/1981 which clearly seperated between polices and district attorney role and function. However, the core problems seem still present since the police and district attorney attempt to compete their competence handle the particular. This article would attempt to analyse it from three different perspectives: historical, sosiological and yudicial perspectives.
