The Act is aimed to address the issues of the media and telecommunication industries including competition matters. Thus, competition law is introduced in the form of sector-specific legislation. Without a generic competition law and lack of regulatory expertise, the sector-specific regime is challenged to promote a just and equitable approach in the media realm. The policy of merging the media and telecommunications sectors under single classification may put another challenge to apply this legislation. In addition, lack of transparency in dealing with the licensing and anti-competitive matters is not aligned to the spirit of a just and equitable approach. Furthermore, in absence of an ownership law to govern the provisions of all form of consolidation transactions, the media sector is allowed to have one giant conglomerate controlling all the commercial television stations nationwide. This paper aims to examine the above issues and challenges in controlling anticompetitive conduct in the media and telecommunications market in light of a just and equitable approach. The paper commences with a brief history of the media and telecommunications industry and legislation and background of the Malaysian competition regime. It goes on to analyse the issues and challenges in controlling anticompetitive behaviour. The paper ends with a summary and recommendations for the development of the competition scheme in Malaysia.
