Abstract
This paper argues that the coastal fishers are burdened by several strictures and proposes that coastal States need to adopt comprehensive sub-regional or regional legal framework, that comprise pro-poor legislation and pro-small scale fisheries principles to assist them. The solution that small-scale fishers need pro-poor legislation and pro-small scale fisheries principles is based upon the FAO Fisheries Technical Paper 481. This paper will focus on these two seemingly conflicting obligations of States and how far these provisions guarantee the right to a livelihood under the Universal Declaration of Human Rights 1948 of the small-scale fishers. This paper will examine (1) the human right of the small scale fishers to a livelihood; (2) the nature of the contiguous zone; (3) the provisions of the 1982 LOSC in regulating fisheries; (4) the generic principles of marine environmental protection; and (5) adequacy of fishery regulations for States. This paper does not examine or argue on the political and civil rights of the various groups of coastal islanders fighting for self-determination.
