Constitutionalism is a universal value; it is neither east nor west. However the Western imprint is rather obvious and most of the modern constitutions today display that characteristic, mostly taken from their former colonial masters. In Malaysia that is exactly the case but after fifty years there seems to be quite a distinctive brand of constitutionalism. Although it has some similarities with the rest of the world, the local variations are quite evident. Undoubtedly these underline both the Malaysian and Asian versions of constitutionalism. While people from other parts of the world may find these quite difficult to accept these are obviously what justice and equity is all about. |
