This essay was sparked in part by my long-standing interest in the case of Wisconsisn v. Yoder, decided two decades ago. This case presented a clash between a Winconsin state law, which required school attendance until age sixteen, nad the Old Order Amish community, which claimed that high school attendance was contrary to their religion and would impede them in the constitutionally guaranteed free exercise thereof. The majority of the Court argued that, as a general matter, free exercise must take precendence unless confronted with compelling state interets and that, in the case at hand, Wisconsin had failed to make out a plausible case at hand, Wisconsin had failed to make out plausible case that its undoubtedly genuine interest ought to be regarded as compelling.
