Isi artikelThis essay will deal with the issues unresolved by the 1969 vienna convention on the law of treaties (VCLT), reservations and declarations to human rights treaties. In fact, declarations to treaties were left out entirely from the scope of the VCLT. This article will also analyse in depth the general development of the institution of the reservations to treaties including the current work on this topic by the international law commission and the recent jurisprudence of the international court of justice. The essay takes into account the relevant jurisprudence of the european and inter - american courts of human rights and provides an extensive analysis of the legal character of declarations attached to the rome statue of the international criminal court.
