Market plays an important role in competition law. Nevertheless, competition cannot be analyzed based on a broad and general market, and therefore it is significantly necessary to identify the market to delineate competition analysis. Product market and geographic market are the two main criterias to determine relevant market in the Law of the Republic of Indonesia Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. Furthermore, those criterias will delineate the scope of market to determine there existence or restrictive business practices, those are practices which could result in the occurrence of monopolistic practices and/or unfair business competition, in the form of price fixing, boycott, monopoly, monopsony, market control, the use of dominant position hi general and/or in the form of interlocking directories and/or share ownership. |
