We find that : (i) expectation damages perform very poorly, inducing no cooperative investment ; (ii) privately stipulated liquidated damages can achieve a better, albeit inefficient, outcome; and (iii) the reliance damages perform the best, achieving the efficient outcome if ex post renegotiation is possible.
