Lay off is a crucial problem for laborers. This signifies the start of suffering by laborers and their family. There are several reasons why lay off occur, among others, due to fault of laborers, employer demand or it could be caused by economic crisis such as presently experienced by Indonesia, Employers have to avoid by lay off of laborers, but in extraordinary situations such as economic crisis, it is almost impossible to prevent this situation. In this case, the government should use discretion when permitting employers to lay off laborers. The employers are expeted to provide sufficient separation payment especially during the time when laborers are temporarily jobless.
