A Creditor could appeal to the Trade Court for taking hostage, in case of : a Debtor fail to settle his payment or a Guarantor fails to fulfil his obligation when the debt has been expired, a debtor or guarantor does not show a proper behaviour as required, and / or a debtor or guarantor does not have a cooperative attitude. Meanwhile, a debtor and / or his guarantor having an IDR of one billion credit at the first time could be kept as "hostage". During a hostage status, the prisoner was isolated from outside world, did not allowed to be outside or to leave the house, expect for a certain extent. Abandoned to speak and/or to communicate to anybody, to read a newspaper or magazine, to listen to the radio, to watch a television, to use an internet, to call anybody, and to send or receive a letter. f a debtor or his guarantor is an individual, he or she will be taken as a hostage. If a debtor and / or his guarantor is a Private Company, a Board of Director and / or Commissioner, individually will be charged as a hostage when a report of audit published by a Registered Public Accountants or by a Law Firm Consultants disclosed information about the intervention of the BOD and / or Commisioner in decision making processes of the company's policies. An individual as amain satkeholder could be regarded as a hostage, if an audited report by a Registered Public Accountants or by a Law Firm Consultants disclosed information about the intervention of the stakeholders in decision making processes of the company's policies.
