Isi artikelAccording to the Indonesian law corruption is any deed included into the 17 formulations of offense as contained in Law No. 3 of 1971. 13 out of them refer to articles of the Criminal Codes which in general concern functional offenses and bribery. Unlike the juridical definition of corruption haviny the obvious reference, collusion and nepotism in Indonesia have no legal reference. No Formulation in the existing law doee state that they are comes. Both terminologies is more sociological than legal. However in the current condition, the government has proposed a new 'Bill on Anti Corruption" besides that on Clean Governance." The improvement in Law on Anti Corruption among others includes: (i) a person may not only be subject to corruption but a corporation may as well; (ii) sentence of any criminal case will vari in accordance with the quality of corruption offense (different from the current existing one, having the same maximum and minimum penal sanction) (iii) the presumption of guilt will be applied though limitedly, and (iv) public's participation such as NGOs is allowed to reveal a corruption case.
