Air space is important for the state, not only to protect its national security but also to support economic development. Article 1 of the 1944 Chicago Convention states that every state has complete and exclusive sovereignty over the air space above its territory. Indonesia has National Law No. 15 year 1992 on Navigation. Presently, Indonesia has used its air space territory that provide more economic cost efficiency compaed to its land and sea territory, such as navigation, telecommunication and electricity infrastructure, radio band, bridge and skyscraper building, etc. Indonesia faces numerous problems in defending its ai space sovereignty, especially such contrary conditions of the existing law related to air space regulation (Chicago Convention, 1944 and UNCLOS, 1982), lackof military technology of the Indonesian air force, and the boundaries of Indonesian air space territory.
