Isi artikelPeople who buy low-price house using 15-20 year loan facilitated by Bank Tabungan Negara (BTN) will get their house certificate after paying off their loan. Due to the government regulation number 40/1996 about “Hak Guna Usaha, Hak Guna Bangunan dan Hak Pakai Atas Tanah“, developers get Rights for Building Usage (Hak Guna Bangunan, HGB). Consequently, certificate given to the owner will also be in the HGB form which is less powerful than Property Rights (Hak Milik, HM). While HGB is limited only as right to manage the piece of land, HM provides legal basis for the owner to status, border, and position of their land. A research in 9 housing complexes in Tangerang municipality involving 107 house owners selected randomly shows that only 68,68% of them have changed their land status. This happen despites facts that 95,5% has received the certificate and 96,3% aware of time limitation in the HGB.
