Most practitioners of the construction industry consider that contract management is the most important because every business begins and last with a contract. Mastering technical aspect of construction is considered -being insufficient because the risk generated by contractual arrangement can threaten the goals of project. Therefore, understanding contract management is considered to be a very important business for construction. This study aims at identifying current practice in contract management and factors influencing contractors in selecting two major contractual agree¬ments: Contract legalized by Notary or contract non-legalized. One hundred and seven contractors from 12 major cities in Indonesia (Dili, Kupang, Mataram, Surabaya, Semarang, Solo, Yogyakar¬ta, Sumedang, Bandung, Jakarta, Pekanbaru, and Batam) participated in this study. Results indicate that (1) although 83% of the respondents considered very important to practice contract legalized by notary, they mostly use the non-legalized contract. (2) The reasons for not practicing the contract legalized by notary are: (a) lack of legal arrangement; (b) the size of the project in term of cost is small; and (c) being satisfy with the simplicity of the non-legalized contract.
