Technology is a necessity that can not be ignored today. One indication of the developed country can be seen from the development of its technology, and Indonesia seems to have not been included in the criteria. Although since the enactment of the Law No. 1 of 1967 on Foreign Investment in the accomplishment of which suggests the transfer of technology, but the positive law in Indonesia has not been set on the mechanism or procedure for the transfer of technology in foreign investment itself. Law No. 25 of 2007 only mentions the obligation of foreign investors to apply technology tranfer to the Indonesian workers, but did not explain the mechanisms and procedures for the implementation of the technology transfer. The foreign investment activities are supposed to be one of the entry point to the welfare of the people of Indonesia through technology transfer, however, it is constrained by the lack of binding legal and certainty regulation to achieve the implementation of technology transfer in foreign direct investment. As a result, Indonesia became an un-independent nation and tend to rely on foreign workers in the various fields of business. Regulation on technology transfer in foreign direct investment should be realized so as to create a binding legal certainty and favorable for foreign investors and Indonesia as the host country.
