Existence of government liability actually is one of the balancing mecha nism the position among the government and the community in exercising the state organization. The government have its authority to rule, picking the tax, enforce the law and sanction, and so fort, which are a set of “authority” in the afford to realize the nation life goal. Meanwhile, the society have its rights to gain the law protection againsts various government activity that possibly cause harm on society. Therefore, the existence of the government liability in fact provide enough space for the rising of public participation which is necessary for democratic government.
