This paper tries to explain four main problems which relate to the draft of religion harmony act (RHA). Substances of the analysis and conclusions of this paper are : first, the basis considerations of the draft of RHA is not a precise one since religion is not the main factor that contributes to apprehension and social conflict in indonesia. Economic and politic factors are the main determinant factors of apprehension and social conflict in indonesia. Second, generally, the substance of the draft of RHA contradict to human rights as regulated in 1945 constitution, national and itnernational humanitarian law. If it is compelled to enter to force, the application will devrease the legality and authority aspect of this act and it will ineffective because philosophically, juridically, and sociologically, the substance of this act is not precise. Third, there are some opportunities to misuse this act by the state and / or other interests group to oppress another interests group. Fourth, there are some certain substances of this act which reveal the role of state in such unimportant and not urgent matter as interment.
