In the correlation between intellectual property rights and the right to health, the challenge is to aintain the balance when a State has to implement international property rights protection agreements, the Trade Related Aspect of Intellectual Property Rights (TRIPs) Agreement, while putting the affordability of medicines in the first place. Indonesia has approached to this issue by taking the option of 'government use'. It is worth to find out to what extent can patent protection agreements assist International Covenant on Economic Social and Cultural Rights (ICESCR) member States in delivering their obligation to fulfill the right to health. The TRIPs Agreement itself has some rooms for member States to take measures that limits the rights of patent holders. Looking at Article 7 and Article 8 of TRIPs Agreement, the provision expresses the idea that the TRIPs Agreement is accommodating the effort to balance the rights of the patent holder and the interest of the users. The agreement leaves the interpretation in the light of human rights to the members' discretion. Human rights is a strong argument to make TRIPs Agreement flexibilities to be utilized.
