Isi artikelAs a country which has various culture and customs, Indonesia's constitution gives recognition on the role of customary laws. In this regard, customary laws recognizes various types of traditional ownership of land or the so-called hak or tanah ulayat in different regions, aside from land ownership legitimized by the state or the government. This existence of hak or tanah ulayat is also respected in the Agrarian Principle Law (UUPA) from 1960s. Unfortunately, the traditional ownership of land has not been acknowledged in the current debating bill on land acquisitions for development. The writer argued that the hak or tanah ulayat must be actually stipulated in the respected bill to protect traditional rights and accesses to land in many regions of the country.
