The Child Convention as International convention which Indonesia already ratified demands that state parties protect and promote the rights of the child. On of these right concerns the right of child to be provided special protection in case the child in involved in any legal conflict or dispute. This entails that a child is protected against such incidence. Nonetheless, in the Presidential Regulation 36/1990, the child is still considered fully in capacity to bear legal responsibilities. It opens the possibility of bringing a child before a children criminal court and indicts him/her.
