| This research reviewed the Decision of the Constitutional Court of the Republic of Indonesia Number 012 / PUU-1/2003 About the Testing of Law Number 13 Year 2003 About Manpower Article 158 concerning grave errors and any payments arising from termination of employment resulting from grave errors. The research conducted for this thesis is the Juridical Normative legal research, that is research done by reviewing the rules of law applicable or applied to a certain legal problem. The result of this legal research is the denial / overriding of legal certainty and this will create new legal uncertainty whereas legal certainty or procedural justice is needed for the justice seekers. The implications of the verdict do not necessarily solve the problems it can create new problems in working relationships. |
