State Budget (APBN) becomes the main instrument for Indonesian government to manage the income and spending of the country to reach people's welfare. However, it needs join understanding between parliament and government in order to achieve the amount of budget target for the instrument of welfare particularly on the education budget allocation as mandated by the Constitution. This study aims to explore the constitutional mandate for education budget, in which this study shows that, basically, the state has been able to allocate 20% for education sector as seen from the trend of increasing state budget spending. However, this trend likely is always dragging the state budget into a defisit situation. This situation bring a lot of benefits for people's welfare eventhough government applied a deficed budget policy. Therefore, parliament and government have to commit on prioritizing the education budget each year through budget planning, controlling and accountability in the use of it.
