Isi artikelThe principal objectiveof the article is to question the applicabilityof article 1(4) of the 1977 additional. Protocol I to the Geneva Convention of 12 August 1949, and relating to the Protection of Victims of International Armed Conflicts (Protocol I) in relation to the exercise of the right to self-determination. Taking the armed conflict situation in East Timor, which was a result of a struggle against alien occupation, as a case study, the article attempts to unpack the key elements of article 1(4). Whether in such an armed conflictsituation similar to East Timor where peoples are fighting against colonial domination, alien occupation, or against racist regimes, the right to self-determination can be justified. Although article 1(4) has never been applied in any armed conflict situation in the world given that it often clashes with the concept of territorial integrity of "an existing sovereign state", one ought to always recall the bottom-line purpose of Additional Protocol I, that is, to provide protection for victims of war.
