This research discusses about the application of reversal burden of proof on corruption case in Indonesia. The issues of this research are how is the application of reversal burden of proof on corruption case in Indonesia and specifically discussed (1) how the application of reversal burden of proof in verdict case number 199 K / Pid Sus / 2012 (2) how is the result of the application of reversal burden of proof for the defendant in verdict case number 199 K / Pid Sus / 2012 This study uses normative juridical method, this research uses secondary data, and which analyzed by qualitatively. Corruption is classified as an extraordinary crime. Therefore, the eradication of corruption is demanded in an extraordinary way, one of them through reversal burden of proof. Reversal burden of proof is a right given to the defendant to prove that he/she has not committed a corruption and is obligated to provide information about all of his property and property of his wife or her husband, children and property of any person or corporation which have connection with the corruption case. The prosecutors still have the obligation to prove their assertion. The application of reversal burden of proof in corruption cases provides a positive contribution in the context of combating corruption irrespective of the numerous pros and cons of various circles. The application of reversal burden of proof is very important to eradite corruption in Indonesia. In verdict case number 199 K/ PID SUS/ 2012, the application of reversal burden of proof helped judges to decide this case. Because the judge can see the information from two parties through the Prosecutor and the defendant, so that corruption can be proven. The regulation of reversal burden of proof must be balance between the protection of the individual's liberty and the deprivation of the individual's rights over his alleged wealth derived from corruption. Eradication of corruption can not be separated from the role of society in supervising and reporting if there is a criminal act of corruption. |
