In law, a malpractice is defined as an improper or negligent treatment of a patient by physician resulting injury, damage, loss or death. The malpractice has been already occurred not only in Indonesia, but also in some other developing countries. The objective of this paper is to observe the criminal justice system on malpractices which could be implemented for all cases occurred in Indonesian society. The methods used descriptive analysis of the data collected from the library research and other resources. It is important to note that in order to avoid the malpractices in the future and it is compulsory to implement the law enforcement and the court must sentence the tight sanction to the malpractices.
