This study is aimed to understand and review the aspects related to the use of Intellectual Property (IP) economically, especially as collateral for a credit to the owner or holder of the IP which are Micro, Small and Medium Enterprises (SMEs). The goals to be achieved in this study is to consider the prospects of the use of IP as collateral by SMEs and the potential problems that may arise in its implementation, it is hoping to have an overview of the steps that must be anticipated by the Indonesian government. This is a qualitative juridical normative study where the related available data to the research questions such as legal principles contained in SMEs, collateral securities and IP were collected and studied to understand the extent that the study objectives can be achieved with maximum results. From the study that has been carried out, there are bright spots from some of new laws enacted by government such as Law No. 28 of 2014 on Copyright and the Law No. 13 of 2016 on Patent which provides fiduciary as collateral. |
