In this paper it will be argued that the law protecting employees from unfair dismissal has provided only limited protection whilst at the same time it has lead to a formalization and legitimation of the power of management to take decisions concerning dismissals . The legal right to challenge the fairness of a dismissal is set out in the Employment Protection (Consolidation) Act 1978 though this has been subject to some amendments in the Employment Acts of 1980 and 1982 .
