| The institutionalization of deliberative lawmaking processes is Habermas's innovative project relating law and democracy through the inner nature of modern society, that is, communicative action. As ordinary language aims to reach mutual understanding through everyday practice of communication, discourse aims to reach valid norms in political and economic realms through arguments. Habermas's theory of law is thus a moral and legal philosophy rather than an empirically oriented study of law. |
