Gambling become real threat or potential to social norm so can threaten social orderliness. Thereby gambling can be national development resistor which have material-spiritual aspect. Therefore, gambling have to overcome by rational. One of rational effort is with criminal law policy approach. Problems which faced are existing of criminal law policy in Indonesia in this time have adequate in order to overcoming gambling and how policy of criminal law aplikative. And also how policy of criminal law formulation in future to overcome gambling. This research using normative yuridical method, that is studying or analyzing secondary data which in the form materials of secondary law by comprehending law as peripheral regulation or positive norms in legislation system which regulate about human life. So, this research comprehended as research library, that is research to secondary data. Regulation about gambling have been arranged in Criminal Code law (KUHP) according to changed regulation No. 7 Year 1974 about publisher of gambling. But policy of law and regulation formulation have some weakness. At aplikative phase, judge not free to determine crime sanction type to be imposed to gambling maker. This matter caused by maximum and minimum common systems which embraced by KUHP, so that any crime sanction type which decanted in regulation have to applied by judge. Policy of gambling overcoming in the future remain to must be done with penal medium. Policy of criminal law Formulation have to be more optimal and can to reach gambling growth with have sophisticated technological medium.
