Isi artikelThe Bio-terrorism Act (BTA) has objective to protect the US citizen public health and other nation's food supply against the threat of intentional contamination and bio-terrorism. The Food and Drug Administration (FDA) has been appointed to control the good safety measures, to render such regulations as on Registration of Food Facilities, Prior Notice of Imported Food Establishment and Maintenance of Records, as well as Administration Detention. BTA stimulates FDA to improve its capabilities of inspection, detention, and food security. In the implementation of BTA, therefore, FDA is also considering regulatory guidance includes the regulations on debarment, labelling, import for export, and port shopping. The application of BTA will definitely have some impacts on international trading transaction. The major implication oh the BTA will be the registration requirement that must be fulfilled by the food exporters. Although the registration has not been announced yet, it is feared that this obligation will be a substantial burden for the food exporters, including Indonesian food exporters. The chairman of Indonesian Chamber of Commerce, for example, has reacted that the BTA was similar with the quota policy upon products which were exporters to the US. The fear of Indonesian Exporters is quite reasonable, since many of them are small and medium business entities which will have difficulties in fulfilling the BTA requirements because of cost reason and administration barrier. As indicated by the Ministry of Trade and Industry of Republic of Indonesia which argued that BTA was a trade barrier, in particular non-tariff barrier.
