It is a must that the process of general election needs law enforcement in every step of electoral process and all the process of election should be done in democratic principles such as direct, free and fair, accountable and accesseble. Somehow, the Electoral Law Number 10 year of 2008 remains some uncertain law enforcement and inconsistencies for the electoral process of legislative member for DPR, DPD and DPRD in 2009. There are twenty five documented as vacant law enforcement which could race more problems in the election. Among those 25 mistake one of them is that no rule for regency/municipality with high density whether they get 12 seats or the electoral region is divided. The same problem was a repitition of the Law number 12 year of 2003 which also not mention the regions that had more than 12 seats. The inconsistency of the Law Number 10 year of 2008 also found in at least eleven matters. One of them is that article 23 (2) states that seats allocation of DPRD province could have more seats than election 2004, in contrast article 24 (2) affirm that number of seats in every electoral region for province DPRD should be the same number as 2004 election. Another problem of this law is the multi interpretation in some articles and they are 13 puzzled objects. In turn, these three problematic the setbacks will be strongly impact to the electoral management body (KPU). It is true that KPU can not blame the law but to implement them with full of responsibility. The drafting law should coverage the law completely so that KPU just need to execute them.
